1. About these Terms & who we are
These Terms of Service (also our "Regulamin" under the Polish Act of 18 July 2002 on providing services by electronic means) govern your use of Quibench ("Service"). The Service is operated by Katsiaryna Anikeich, a sole trader registered in Poland (NIP: 5252963522) ("Quibench", "we", "us"). We offer the Service to business customers in the United Kingdom, the European Union and elsewhere.
Business use only. The Service is intended for businesses and professionals (recruitment agencies and recruiters). By using it you confirm you are acting in connection with your business or professional activity, and the contract is of a professional (B2B) character for you. The Service is not intended for consumers.
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. The Service & technical requirements
Quibench provides an AI-assisted CV formatting, redaction and editing service. You can upload candidate CVs, apply formatting templates, redact personal details and export standardised profiles.
Technical requirements: a current version of a standard web browser, an active internet connection, and a valid account. We may change or improve features over time; we do not guarantee any specific feature, result or uninterrupted availability unless separately agreed in writing.
3. Account registration
- You must provide accurate and complete registration information
- You are responsible for maintaining the security of your account and credentials
- You must notify us immediately of any unauthorised access
- You are responsible for all activity under your account
4. Acceptable use & your content
You agree NOT to:
- Provide or upload content that is unlawful, infringing, or that you have no right to process
- Upload candidate CVs without a valid lawful basis (e.g. the candidate's consent) to process them
- Use the Service in breach of any data protection, employment or other applicable law (including the UK GDPR, EU GDPR and equality/anti-discrimination law)
- Attempt to reverse engineer, copy or extract our software, AI models or templates
- Use automated means to access the Service beyond normal use, or resell/redistribute it without authorisation
- Upload malware, or attempt to disrupt or gain unauthorised access to the Service
You retain ownership of the content you upload. You are solely responsible for that content and for ensuring you may lawfully process it through the Service.
5. Subscriptions, payments & refunds
- Paid plans are billed monthly or annually in advance
- You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
- As a goodwill commercial policy, we may refund an unused subscription within 14 days of the initial purchase; this is not a statutory consumer withdrawal right (the Service is B2B)
- We may change pricing with at least 30 days' notice; changes apply from your next billing period
- We may suspend the Service for overdue payment after notice
6. Intellectual property
Your content: you retain all rights to the CVs and content you upload. You grant us a limited, non-exclusive licence to host and process that content solely to provide the Service to you.
Our Service: Quibench, including its software, AI configuration, templates and interface, is owned by us and protected by intellectual property law. No rights are granted to you except the right to use the Service under these Terms.
7. Data protection
For the candidate CV data you upload, you are the data controller and Quibench acts as your data processor under the UK GDPR and EU GDPR, processing it only on your instructions under our Data Processing Agreement. You are responsible for obtaining a lawful basis (e.g. consent) for that data and for informing candidates. For your account and billing data we are the controller — see our Privacy Policy.
8. AI-generated output — always review it
The Service uses AI to reformat and edit CV content. AI output may contain errors, omissions or inaccuracies, and may be affected by hidden or malicious content in an uploaded document (e.g. prompt injection). You must review and verify every output before relying on it or sharing it. The Service does not provide professional, legal, hiring or advisory services, and AI output is not advice. You remain responsible for any decision you make using the Service.
9. Warranties & disclaimers
To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind (express or implied), including as to merchantability, satisfactory quality, fitness for a particular purpose, accuracy of AI output, or uninterrupted or error-free operation.
10. Limitation of liability
To the maximum extent permitted by applicable law:
- We are not liable for indirect or consequential damages, loss of profit, loss of business or loss of goodwill
- Our total aggregate liability arising out of or in connection with the Service is limited to the amounts you paid us for the Service in the 12 months preceding the event giving rise to the claim
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the law applicable to you — including liability for death or personal injury caused by negligence, for fraud, for damage caused intentionally, and any liability owed to a data subject under data protection law (e.g. Article 82 UK GDPR / GDPR, which cannot be capped).
11. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities and reasonable costs (including legal fees) arising out of or related to: (a) the content you upload or process; (b) your breach of these Terms or of any applicable law (including data protection, employment or anti-discrimination law); (c) your lack of a lawful basis or consent to process candidate data; or (d) a claim by a candidate or third party in connection with your use of the Service.
The party seeking indemnity will promptly notify the other of the claim and let it conduct the defence and settlement (provided no settlement admits fault or imposes an obligation on the indemnified party without consent), and will give reasonable assistance. In turn, if the Service itself (as provided by us, used in accordance with these Terms) infringes a third party's intellectual property rights, we will indemnify you against that claim on the same basis.
12. Suspension & termination
We may suspend or terminate your access if you materially breach these Terms, fail to pay, or use the Service unlawfully. You may stop using the Service and close your account at any time. On termination your right to use the Service ends; you may export your data beforehand, and we delete or return candidate data in line with the Data Processing Agreement.
13. Complaints (reklamacje)
If something is wrong with the Service, you can submit a complaint by email to [email protected], describing the issue and your account. We will acknowledge it and respond without undue delay, and in any event within 30 days of receipt.
14. Changes to the Service or these Terms
We may update the Service and these Terms from time to time. We will notify you of material changes by email or in the Service with reasonable notice. Continued use after changes take effect constitutes acceptance; if you do not accept a change, you may stop using the Service and close your account.
15. Governing law & jurisdiction
These Terms are governed by the law of Poland, and the Polish court having jurisdiction over the seat of Quibench has jurisdiction over disputes with business customers. The UN Convention on Contracts for the International Sale of Goods does not apply. This choice does not deprive a business customer in the United Kingdom or the European Union of the protection of any provisions of their local law that cannot be derogated from by agreement.
16. General
- Force majeure: we are not liable for failure or delay caused by events beyond our reasonable control
- Severability: if any provision is unenforceable, the rest remain in effect
- Assignment: you may not assign these Terms without our consent; we may assign them to a successor of our business
- No waiver: not enforcing a right is not a waiver of it
- Entire agreement: these Terms, the DPA and the Privacy Policy are the entire agreement between us regarding the Service
- Non-reliance: you have not relied on any statement, promise or representation not set out in these Terms (this does not exclude liability for fraud)
- Notices: we may give notices by email or in the Service
